Do the clients make the decisions or the mediator?

In every case, it is the clients who make the decisions, not the mediator. The mediator is a neutral party in the mediation proceeding that is there to help both you, and your spouse to communicate with each other,

  • In mediation, the client makes the decision. The mediator is there to help you communicate, weigh your options, reach an understanding, and craft an agreement for your family
  • How your children will be parented, who will make educational decisions in the future, timing and transportation for visitation, and holiday arrangements – you will make those decisions. This is your agreement, but the mediator can help you reach it
