As a mediator, I act as a facilitator to help parties, spouses, or parents resolve the issues that need to be discussed and decided in the context of a divorce, separation, or an annulment. There are going to be challenging issues such as parenting and custody. How do we manage? What does the new family look like? What is going to happen with the finances? Who’s keeping what? How am I going to live? How am I going to support myself?
Parties must communicate and they need a voice in mediation. My role is to facilitate and help you communicate, come up with options, and help each of you be able to hear the other and to weigh the legalities and the concerns that you have. Ultimately, my role is also to take that agreement and put it in writing in a way that it can be presented to the court. This way the judge can understand it, and make a finding that your agreement is fair and equitable.
If dealing with children, the judge will be able to scrutinize and to make a determination whether or not what you have constructed is best for your children. It is, again, specific to your needs. My role is to help you reach that compromise and reach that agreement.
