images (1)In mediation, it is not productive to speak about the misconduct of the other party.We don’t want to fan the emotions and hostility of this divorce. We want to have a situation and an atmosphere where there is communication and cooperation. However, if the misconduct directly impacts the equitable distribution of funds, that would otherwise support a child or a spouse, then it is relevant and will be discussed.

In the event that finances are brought up in mediation and you discover that your spouse has used some of your marital funds on the third party involved in the extramarital affair, you may be able to recoup some of those funds, which may be discussed in mediation.
